Lean BI Tech ApS (Lean BI Tech) respects your privacy. This Privacy Policy describes your privacy rights and our obligation to secure your personal information. 

Lean BI Tech is a Danish company. Lean BI Tech provides software and services to private companies (Customers) in Europe under the Decision Beacon name. Lean BI Tech's head office is located in Hørsholm, Denmark, and Lean BI Tech is subject to European personal data legislation, including the General Data Protection Regulation (GDPR)

This Personal Data Policy is available on our DecisionBeacon.com, LeanBITech.dk website and at the bottom of any Lean BI Tech owned website.

When and in what context does this Personal Data Policy apply?

This Privacy Policy applies to all business processes and to all Lean BI Tech and Decision Beacon websites, domains, mobile solutions, cloud services and communities (Lean BI Tech Sites). In addition, for specific services, there may be additional terms for the provision of services, data processing agreements or similar information for a specific service. 

The personal data policy informs about the data processing, which is performed by Lean BI Tech as data controller, where Lean BI Tech determines for what purpose and with how the processing is performed. It also discloses the data processing that Lean BI Tech performs on behalf of our Customers on the basis of their instructions (Customer as data controller and Lean BI Tech as data processor).

Definitions

Personal information is information that can identify you as a person, e.g. e-mail address, postal address or telephone number etc. It is necessary to process your personal information in order to serve our Customers. Please do not use Lean BI Tech Sites or our services if you do not accept the way we process personal information in accordance with this Privacy Policy.

We have not taken steps to ensure the processing of personal data. Therefore, do not use Lean BI Tech Sites or our services if you intend to store sensitive personal data in our systems.

If personal data processes Lean BI Tech?

Lean BI Tech processes personal information about job applicants and contacts or software users, which is affiliated with our Customers. We also process personal information about persons who constitute potential Customers (Leads) or business partners (Partners), which contact us through Lean BI Tech Sites or through other channels. The personal data policy for these persons can be found in the section 'How does Lean BI Tech process personal data in its role as data controller?'.

For our Customers, we also process data. Here the Customer controls the data processing. Our Personal Data Policy in these respects can be found in the section 'How does Lean BI Tech process personal data in its role as data processor?' 

In this Personal Data Policy, data subjects may also be referred to as persons or you.

How does Lean BI Tech process personal data in its role as data controller?

Lean BI Tech collects personal information, in connection with the fact that you are a jobseeker, that you are a representative of a Customer or a Lead, when you are a representative of a Partner or when you are a software user.

 

Why we process personal data

About Customer Contacts and Software Users

In order to manage our Customer Relationships and to fulfill our obligations to our Customers, Lean BI Tech needs information about you in your role as Customer or Partner contact person or user of a service. The purposes of processing this personal data are:

  1. to complete the sales and contract process for Customers
  2. to provide the agreed services to you or Customers
  3. to provide the desired and necessary support to users of our services
  4. to continuously improve the quality and functionality of our services, as well as your of our services as a user
  5. to deal with and prevent possible security threats, as well as general system maintenance and troubleshooting
  6. to prevent misuse of our services
  7. to handle customer relationships through order processing, invoicing, payment and other financial tasks
  8. to run user communities where users and Lean BI Tech can interact and exchange knowledge.

The legal basis for processing personal data for the purposes set out in letters A) to I) above is primarily based on the fact that, from a business perspective, Lean BI Tech has a legitimate interest in processing your personal data in a manner which, in our view, does not is in conflict with your rights regarding personal data protection and self-determination. The legal basis for processing your personal data for the purpose specified in letter J) is your consent.

About leads

Lean BI Tech processes personal information about Leads for marketing purposes. In order to deliver targeted and relevant content to potential Customers, Lean BI Tech builds an interest profile based on your activity and your choices and actions on Lean BI Tech Sites as well as your response to marketing content by email. The legal basis for such treatment is primarily your consent. 

In the sections below, you can read how we create such profiles, how you can adjust the profile, and how to revoke your consent.

About job seekers

If you are a job seeker, we process personal information to evaluate your potential as a Lean BI Tech employee. The legal basis for such treatment is your consent.

About partners

Lean BI Tech processes personal data about Partners for the purpose of sales, knowledge exchange, competence building, in order to establish the necessary contact to carry out the business activities in which a Partner is involved. The legal basis for such processing is primarily your consent. 

 

How we collect personal information

In general, Lean BI Tech collects personal information directly from you or other persons associated with our Customer. It can be, for example, a manager or colleague. If the Customer you work for purchases services from Lean BI Tech through a partner company to Lean BI Tech, we may collect information about you from the partner company. 

We also use cookies and other tracking technologies, on Lean BI Tech Sites and when you interact with us by email, to provide a better experience of our sites. See the 'Automatic Data Collection Tools' section for more information on how it works and what your rights are in this context.

In some cases, we may also collect information about you from other sources. These sources may be Lean BI Tech's marketing partners, public sources or third party social networks. Lean BI Tech will be able to combine personal information about you collected from one source with information obtained from another source. Lean BI Tech uses the digital marketing tool Mautic provided by Mautic Inc, owned by Acquia. Mautics tracking pixel places cookies on your computer to recognize a returning visitor as a unique user. Mautic is used to record your behavior on our sites and how you interact with us by email to increase the likelihood of delivering content that is in line with your interests. The cookies placed by Mautic cannot access, read or change other data on your computer. Google Analytics

This cookie allows us to see information about website activities for users, including - but not limited to - page views, source and time spent on a website. The information is anonymised and displayed as numbers, which means that it cannot be traced back to individuals. This helps protect your privacy. Google Analytics Remarketing

Puts cookies on your computer, which means that when you leave our website, Google may show you ads about Lean BI Tech that you may be interested in based on your past behavior on our website. This information is not personally identifiable.

What personal information we process

The type of personal information that Lean BI Tech processes about you can be:

If you post anything in Lean BI Tech's user community or in other forums on Lean BI Tech Sites, the information may be read and used by anyone with access to those forums, and may be used for purposes outside Lean BI Tech's or your own control. Lean BI Tech is not responsible for any information you submit to such forums on Lean BI Tech Sites. Lean BI Tech does not publish comments, recommendations or the like prepared by you without your prior consent.

Business partners

Lean BI Tech may share your personal information with our partners, provided that this is legitimate from a business perspective and in accordance with applicable data protection laws. For example, if you purchase our services through one of our partners, Lean BI Tech and our partner may share personal information in order to provide the service to the Customer.

Public authorities

Police and other authorities may require that personal information from Lean BI Tech be disclosed. In these cases, Lean BI Tech will only disclose the information if there is a court order, etc., which offers to do so.

MUST

In connection with mergers and acquisitions or divestitures of all or part of Lean BI Tech's business, the acquiring entity and its consultants will have access to the information managed by the Lean BI Tech entity (s) involved. In some cases, this may include personal information. In M&A cases, the external parties will enter into a confidentiality agreement with Lean BI Tech.

What rights do you have?

The right to opt out of marketing communications

You have the right to opt out of receiving marketing communications from Lean BI Tech and can do so either by:

  2. contact us by email at info@leanbitech.dk

Please note that even if you opt out of receiving marketing communications, you may still receive administrative communications from Lean BI Tech. This can be, for example, order confirmations and notifications that are necessary to manage your account or the services provided to our Customers.

Fundamental rights

You have the right to access your personal information by requesting an overview of personal information about you, and you may have a right to data portability. You also have the right to request Lean BI Tech to correct inaccuracies in your personal information. If you have an account with Lean BI Tech for a Lean BI Tech Site, this can usually be done through the relevant “your account” or “your profile” section of the relevant Lean BI Tech Site or service. 

You also have the right to request the deletion of personal data and to limit or object to our processing of your personal data in accordance with this Personal Data Policy or other service-specific terms.

Finally, you also have the right to submit a complaint to the Danish Data Protection Agency regarding our processing of your personal data.

How does Lean BI Tech secure and store your personal data?

How we secure your personal information

Lean BI Tech takes the trust you and our Customers show us very seriously. Lean BI Tech undertakes to avoid unauthorized access, publication or other deviating processing of personal data.

Personal data is not stored longer than necessary to fulfill the purpose for which it was collected, unless the storage is necessary to meet national legal requirements, including statutory retention periods in connection with control of EU subsidies, bookkeeping, etc.

It is Lean BI Tech's policy to protect personal data by taking adequate technical and organizational security measures. When your personal information is no longer needed, we will ensure that it is deleted in a secure manner or pseudonymised or anonymised.

 

Among other things, took the following precautions:

  • Data processing agreements with subcontractors which process data on behalf of Lean BI Tech.
  • Classification of personal data that ensures implementation of security measures at the level of the risk assessment.
  • Evaluate the use of encryption and pseudonymization as risk-reducing factors.

How does Lean BI Tech process personal data in its role as data processor?

Lean BI Tech provides decision support services to our Customers. Our services involve the processing of Customers' data, including their personal information. The purpose of the processing is decided by our customers, not by Lean BI Tech, which is why the Customer is the data controller. Lean BI Tech acts in such cases as a data processor and processes the data on behalf of and in accordance with instructions given by the Customer. The relationship between the Customer as data controller and Lean BI Tech as data processor must be regulated by a data processing agreement.

The customer's and Lean BI Tech's obligations

When the Customer acts as data controller, the Customer must, in accordance with applicable legislation on data protection, ensure the legal basis for the processing of personal data. The customer must also assess and establish ownership of the risks to which data subjects are exposed through the processing of their personal data. Another important aspect of the Customer's obligations as data controller is to comply with the disclosure obligation in relation to data subjects. 

Lean BI Tech is a natural part of the Customer's obligations as data controller, in the sense that Lean BI Tech's services form part of the processing of personal data, which the Customer must ensure is in accordance with applicable data protection legislation. Thus, when Lean BI Tech processes personal data on behalf of its Customers, we must do so in accordance with applicable data protection legislation for data processors.      

In short, the Customer and Lean BI Tech are obliged to cooperate to ensure the personal data protection of data subjects. Lean BI Tech provides the necessary information to the Customer so that he can act in accordance with applicable data protection legislation.

To what extent does Lean BI Tech use subcontractors?

Lean BI Tech uses subcontractors to process personal data and may in this connection export your or our Customers' data to a place outside the EU. These subcontractors are typically providers of cloud services or other IT hosting services. 

When using subcontractors, Lean BI Tech will enter into a data processing agreement (DPA) with subcontractors to secure your personal data rights and to fulfill our obligations to our Customers. When subcontractors are located outside the EU, Lean BI Tech secures the legal basis for such international transfers on behalf of you or our Customers, including by relying on the EU Commission's standard contract terms.

Lean BI Tech relies on some strategic external third parties to support our business processes and provide our cloud services. These third parties include, but are not limited to:

Google (US), provider of our email, office automation and file storage solution. Regulated under the European Commission Standard Contractual Clauses.

Google (Frankfurt), technical platform provider for our cloud services. Regulated under the European Commission Standard Contractual Clauses.

Simply (DK), provider of website hosting.

e-conomic (DK), accounting information.

Freshworks CRM (US), leads and customer information. Regulated under the European Commission Standard Contractual Clauses.

In any case, you are welcome to request an overview of and more detailed information about Lean BI Tech's subcontractors, including documentation of the legal basis for international transfers mentioned above.

Changes to this Privacy Policy

If we change our Personal Data Policy, we will publish the revised Personal Data Policy here with an updated revision date. We encourage you to review the Personal Data Policy regularly. If we make significant changes to our Personal Data Policy that significantly change our privacy practices, we may also notify you in other ways, such as by sending an email or posting a notice on our website and / or on social media before the changes take effect.
